Cancellation, minimum term and renewal

Last updated: 2026-10-19

1. Scope

This document expands the term and cancellation section of the Service Terms of PEMESE, operated by Luis Fernández Couñago (tax ID 39489174Z). Anything not covered here is governed by those terms.

2. Term and renewal

The contract has an initial term of 12 months from sign-up, and renews automatically for equal periods unless either party says otherwise.

To stop it renewing, notice must be given at least 30 days before the end of the current period. The customer is warned in good time that the date is approaching, so the decision does not come down to an oversight.

3. How to cancel

Write to [email protected] from an email address associated with the account. It is confirmed the same way, stating the date it takes effect.

Cancellation takes effect at the end of the contracted period. Until then the service continues as normal.

4. Early cancellation

If the customer stops using the service before the period ends, the remaining monthly instalments are still payable until it finishes, unless expressly agreed otherwise. Instalments already paid are not refunded.

This does not apply where cancellation follows a breach by the provider or a substantial change to the terms that the customer does not accept; in those cases the contract may be terminated at no cost, with notice given within thirty days of learning about the change.

5. Missed payments

If a monthly instalment is not paid on time, on day 5 of the month the customer is notified inside the application. If it is still unpaid on day 15, the service goes read-only.

Read-only means the customer keeps access to all their information, can consult it, run reports and download it, but cannot record new operations until payment is settled. Access is not suspended and no information is deleted for this reason.

What keeps working in every case, because they are the customer's own legal duties and our unpaid invoice cannot stand in the way of them: issuing invoices and correctives, along with recording, on a booking's account, the payment its invoice needs before it can be issued, and collecting the police guest report details, both at the guest's online check-in and at the front desk.

This is deliberate: a property that cannot close out a stay has a guest standing in front of it, and a full cut-off would pass the problem to a third party who is not part of this contract. For the same reason, while read-only lasts, the booking website stops selling: a booking made then could not be confirmed or cancelled by anyone, and the problem would fall on the guest who made it.

6. What happens to the data

The data belongs to the customer. While the contract is live — including in read-only — it can be exported at any time without asking, from the application itself, as CSV.

After cancellation, data is retained for the period stated in the privacy policy and then deleted, unless a legal retention duty applies. Billing records subject to tax law are kept for as long as that law requires, regardless of cancellation.

When the cancellation takes effect, the application goes read-only —this time invoicing and payments included— and the booking website stops selling, and the customer is sent their data with the date from which it will be deleted, never earlier than 60 days after the cancellation: until then they can look at it and download it, but no longer change it. The return and deletion of data processed on the customer's behalf is governed by the Data Processing Agreement.

7. Price changes

The agreed price holds for the contracted period. Any revision is communicated at least 30 days before renewal, and the customer may choose not to renew if they do not accept it.
