1. Service provider

This service is operated by Luis Fernández Couñago, tax ID 39489174Z, registered at Praza Fonte do Mouro, 2, 2ºD, 36800 Redondela, Pontevedra, contact address [email protected].

2. Purpose

PEMESE is a property management system (PMS) offered as software as a service. It covers reservations, rooms, rates, guests, housekeeping and maintenance, as well as online check-in for the customer's guests.

The commercial and service terms are set out in the Service Terms, and the processing of data on the customer's behalf in the Data Processing Agreement.

3. Access and registration

  • Using the service requires an account with accurate, up-to-date details.
  • Credentials are personal and non-transferable. Users are responsible for keeping them safe and for all activity carried out from their account.
  • Any unauthorised use must be reported immediately to [email protected].

4. Customer obligations

The customer is responsible for the data they enter, including personal data of their guests and staff. In particular they undertake to:

  • Have a lawful basis for processing guest data and to inform guests properly.
  • Comply with the regulations applicable to their accommodation activity, including traveller registration and reporting duties.
  • Not use the service for unlawful purposes or to harm third parties.

5. Availability

The provider will endeavour to keep the service continuously available but does not guarantee uninterrupted operation, particularly where interruptions stem from maintenance, third-party providers or force majeure. Planned downtime will be announced in advance where possible.

6. Intellectual property

The software, brand, design and other elements of the service belong to Luis Fernández Couñago or its licensors. The agreement grants only a non-exclusive, non-transferable right of use for its duration. Data entered by the customer remains the customer's property.

7. Liability

The service is provided with reasonable care. The provider is not liable for damage arising from misuse of the application, from incorrect data entered by the customer, or from the customer's failure to meet their own legal obligations.

8. Term, renewal and cancellation

The contract has an initial term of 12 months from sign-up and renews automatically for equal periods. To stop it renewing, either party must give at least 30 days notice before the end of the current period.

Failure to pay a monthly instalment triggers a notice and, if it is still unpaid on day 15 of the month, the service is limited to read-only: the customer keeps access to their data and can download it, but cannot record new operations until payment is settled. No information is deleted for this reason.

After cancellation, data is retained for the period stated in the privacy policy and then deleted, unless a legal retention duty applies. The detailed terms are set out in Cancellation, minimum term and renewal.

9. Governing law

These terms are governed by Spanish law. Any dispute will be submitted to the courts of the provider's registered address, unless consumer legislation provides otherwise.
